Service Description

New York Pest Control provides professional pest management, wildlife removal, and prevention services to residential and commercial properties throughout New York State. Our services include but are not limited to the inspection, identification, treatment, and monitoring of insects, rodents, birds, and other wildlife. Specific treatment methods, frequencies, and coverage areas will be detailed in your individual service agreement or work order. We utilize integrated pest management approaches combining chemical, biological, and mechanical control methods selected based on the specific pest species, infestation severity, property conditions, and applicable regulatory requirements. All service appointments are scheduled during standard business hours unless after-hours or emergency arrangements are explicitly confirmed in writing. Access to the property, including interior spaces, basements, attics, crawl spaces, and exterior perimeters, is required for proper service delivery. Weather conditions, structural limitations, or undisclosed property hazards may affect our ability to complete scheduled services, and we reserve the right to reschedule or modify treatment plans accordingly.

No Guarantee or Warranty

New York Pest Control does not guarantee complete elimination of all pests from your property. Pest control results vary based on numerous factors beyond our reasonable control, including but not limited to neighboring infestations, structural conditions conducive to pest harborage, client compliance with preparation and prevention recommendations, environmental factors, and pest biology. Any warranties or guarantees explicitly offered will be limited to the specific terms, duration, and conditions stated in your written service agreement. General pest control services do not include coverage for new pest species not identified in the original treatment scope. Bed bug services, termite treatments, and wildlife exclusions carry specific warranty limitations that will be provided separately. We do not warrant against future infestations, damage caused by pests before or after treatment, or conditions resulting from client failure to follow post-treatment instructions. Our liability for any service failure is strictly limited to re-treatment of the affected area or refund of fees paid for the specific unsuccessful service, at our sole discretion.

User Responsibilities

By engaging our services, you agree to provide accurate information regarding the property, existing pest conditions, prior treatments, and any health concerns or sensitivities of occupants including allergies, respiratory conditions, or pregnancy. You must secure or remove pets, cover food preparation surfaces, and comply with all preparation instructions provided before scheduled services. Property access must be available at agreed appointment times; missed appointments due to client unavailability may incur additional fees. You are responsible for maintaining conditions that support pest prevention, including proper sanitation, moisture control, sealing of entry points, and prompt reporting of recurring pest activity. Failure to follow post-treatment instructions, including re-entry timing, ventilation requirements, or cleaning restrictions, may reduce treatment effectiveness and void any applicable warranty coverage. You must obtain necessary permissions for service at rental properties, condominiums, or properties with multiple ownership interests. Payment is due according to the terms specified in your service agreement, and late payments may result in service suspension or additional collection costs.

Limitation of Liability

To the fullest extent permitted by law, New York Pest Control and its employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to our services, including property damage, personal injury, loss of use, lost profits, or emotional distress, regardless of whether such damages were foreseeable or whether we were advised of the possibility thereof. Our total cumulative liability for any claim related to our services shall not exceed the total amount paid by you to New York Pest Control for the specific service giving rise to the claim during the twelve months preceding the claim. This limitation applies regardless of the legal theory asserted, including contract, tort, negligence, strict liability, or otherwise. You acknowledge that pest control involves inherent uncertainties and that our pricing reflects these allocated risk limitations. Some jurisdictions do not permit certain liability exclusions, so these limitations may not apply to you to the extent prohibited by applicable law.

Intellectual Property

All content, materials, trademarks, service marks, logos, trade names, and intellectual property displayed on our website, marketing materials, service documentation, and treatment reports are the exclusive property of New York Pest Control or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our materials without prior written consent. Service agreements, treatment plans, and technical documentation provided to you are for your personal, non-commercial use in connection with the services received and may not be transferred, sold, or disclosed to third parties for competitive purposes. Any feedback, suggestions, or testimonials you provide may be used by us without restriction or compensation. We respect the intellectual property rights of others and expect users of our services to do the same.

Governing Law

These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located in New York County, New York, and you irrevocably submit to the personal jurisdiction and venue of such courts. You waive any objection to jurisdiction or venue on the grounds of inconvenient forum or lack of personal jurisdiction. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If any provision of these terms is held invalid or unenforceable under New York law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

Changes to Terms

New York Pest Control reserves the right to modify, update, or replace these Terms of Service at any time in our sole discretion. Material changes will be communicated to existing clients via email or postal notice to the address on file at least thirty days before becoming effective. Continued use of our services after such modifications constitutes your acceptance of the revised terms. We encourage you to review these terms periodically when accessing our website or engaging our services. Changes required by law, regulatory action, or emergency circumstances may take effect immediately upon notice. Your service agreement may contain additional or different terms that supersede these general terms with respect to the specific services covered therein. In the event of any conflict between these Terms of Service and your written service agreement, the service agreement shall control.
